Time and fault both shape your case
Two years to file
You generally have two years from the date of the injury to file a personal injury lawsuit in Oklahoma. Evidence fades quickly — call early.
The 51% bar
Oklahoma follows modified comparative negligence. You can recover damages if you are 50% or less at fault, reduced by your share of fault. At 51% or more, you recover nothing.

Oklahoma follows a modified comparative negligence standard with a 51% bar. You can recover damages as long as you are 50% or less at fault, though your compensation is reduced by your percentage of fault. If you are 51% or more at fault, you recover nothing.
Our focus is personal injury — auto, 18-wheeler, motorcycle, and train accidents, pharmacy negligence, and wrongful death. We also handle a range of additional practice areas.
Bring any police or accident reports, medical records and bills, insurance correspondence, photos, and contact information for witnesses.
It is best to speak with an attorney before giving any recorded statement. Insurers may use your words to reduce or deny your claim.
